1. Agreement to terms
These Terms of Service ("Terms") form a legal agreement between you and Fertility Minds ("we", "us", "our") and govern your access to and use of our mobile app, website and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Who can use the Service
You must be at least 18 years old to use Fertility Minds. By using the Service, you confirm that you are 18 or over and that the information you provide is accurate.
3. Your account
You are responsible for keeping your account credentials secure and for any activity under your account. Please notify us immediately at hello@fertilityminds.com if you suspect unauthorised access.
4. Subscriptions and payments
Some features of the Service require a paid subscription. Subscriptions are billed through your Apple App Store or Google Play account. Full details of pricing, billing, auto-renewal and cancellation are in our Subscription Terms, which form part of these Terms.
5. Content and community
You retain ownership of the content you post (e.g. community posts, comments, messages). By posting content on the Service, you grant Fertility Minds a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and (in moderated form) share that content for the purpose of operating the Service.
You must follow our Community Guidelines at all times. We may remove content or suspend accounts that breach the Guidelines, with or without notice depending on the severity.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful or fraudulent purpose
- Impersonate any person or misrepresent your affiliation
- Harass, bully or abuse other members
- Post medical advice or content that could mislead other members about treatment options
- Attempt to access or interfere with our systems, other accounts, or any underlying technology
- Use the Service to send unsolicited promotional messages
7. Our content
All content provided by Fertility Minds — including articles, videos, audio, branding and code — is owned by us or our licensors and protected by intellectual property laws. You may access it for personal, non-commercial use only.
8. Wellness service — not medical advice
Fertility Minds is a wellness and community service. We do not provide medical advice, diagnosis or treatment. Content is reviewed by qualified specialists but is for general informational and wellness purposes only. Always consult your GP or fertility clinic for medical questions or before making decisions about your fertility care.
9. Service availability
We aim to keep the Service available at all times but cannot guarantee uninterrupted access. We may suspend or modify features for maintenance, security or other operational reasons.
10. Termination
You may stop using the Service and delete your account at any time via the in-app settings or our account deletion page. We may suspend or terminate your account if you breach these Terms, with notice where reasonably possible.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available". We make no warranties about the accuracy, reliability or fitness of the Service for any particular purpose, except as expressly required by law. This does not exclude any consumer rights you have that cannot lawfully be excluded — including your rights under the Consumer Rights Act 2015.
12. Limitation of liability
Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited. Subject to that, our total liability to you in connection with the Service is limited to the amounts you have paid us in the 12 months before the event giving rise to the claim.
13. Indemnity
You agree to indemnify and hold Fertility Minds harmless from claims arising out of your breach of these Terms or your misuse of the Service.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will give you reasonable notice in the app or by email before they take effect. Your continued use of the Service after the changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except where you are a consumer resident outside England and Wales, in which case you may also bring proceedings in your country of residence.
